the general terms and conditions form the basis for a fair customer relationship. We do our best to provide the best service to our customers to fulfil their satisfaction. When submitting an order, customers agree to the following general terms and conditions.
Scope
The terms and conditions apply to all legal transactions that are concluded via the online shop www.zaffrane.ch. The online shop belongs to and is operated by the seller; Zaffrane Sàrl.
Product, Price & Visuals
Images of products in advertising, brochures, online shops, etc. serve as illustrations and are non-binding. All sales prices published in the online shop are to be understood as final prices including VAT for Switzerland customers. Please note that for deliveries to the EU the import turnover tax can be levied by your Federal Customs Administration. The customs formalities, we do it for you. Promotions on products or prices are applicable for orders in/for Switzerland and EU unless the seller offers a coupon/promotion code to the client individually.
Terms of contract
The products and prices in the online shop are considered an offer, and the seller keeps the right for itself for any variation during the time. The sales contract for the seller’s products is concluded as soon as the customer places their order in the online shop, by phone or email. However, the conclusion of the contract is expressly subject to an actual delivery possibility and a corrector error-free price indication.
The arrival of an online order is indicated to the customer by means of an automatically generated order confirmation from the seller to the e-mail address provided by the customer. The receipt of the automatically generated order confirmation does not contain any assurance that the product can actually be delivered. It only indicates to the customer that the order placed has arrived at the online shop and that the contract with the customer has therefore come about under the condition that delivery is possible and that the price is correct or error-free.
Accuracy of Billing and Account Information
Please note that we reserve the right to reject any order you place with us. In our sole discretion, we may limit, delete, or cancel quantities purchased per household, per person, or per order. You may be restricted from placing orders by the same customer account, using the same credit card, or using the same shipping and/or billing address. Our sales representatives may attempt to notify you of changes to or cancellations of orders by email or by sending a text message to the e-mail or phone number provided at the time the order was placed. Orders that appear to have come from dealers, resellers, or distributors may be limited or prohibited, based on our sole discretion.
For all purchases made at our store, you agree to provide us with current, complete, and accurate information regarding your account and purchase history. As part of this agreement, you agree to update your account and other information, including your email address and credit card numbers and expiration dates, as soon as possible so that we can complete your transactions and contact you as necessary.
Inspection obligation and warranty
Customers must immediately check delivered or picked up products for correctness, completeness and delivery damage. Delivery damage, incorrect and incomplete deliveries must be reported within 5 calendar days from the time of collection or delivery; thereafter the delivery is considered approved. Any compensation for damage caused by the customer directly or indirectly through a bad delivery is hereby expressly excluded. The seller is entitled, but not obliged, to deliver a replacement. Liability and Disclaimer
Liability is based on the applicable statutory provisions. However, the seller is in no way liable for (i) slight negligence, (ii) indirect and consequential damage and consequential damage and loss of profit, (iii) unrealized savings, (iv) damage from delayed delivery and (v) any acts or omissions of auxiliary persons the seller, whether of a contractual or non-contractual nature.
Payments and late payments
Payments must be made in Swiss Francs (CHF) for Switzerland clients and in Euro (€)for EU clients. The payment options offered as a means of payment in the online shop under “Payment Options” are available to customers. When paying by credit card or other instant payment methods, the charge is made when the order is placed. In the case of prepayment, delivery will only take place after receipt of payment. The products are reserved by the seller for 10 days.
Change of order or cancellation
Customers are obliged to accept the products they have ordered. The seller can accept subsequent changes or cancellations of orders from customers at its own discretion. If after an order or the conclusion of a contract a (partial) delivery impossibility (dissolving condition) occurs, the customer will be informed immediately by email. If the customer has already paid, this amount will be refunded. If no payment has been made yet, customers are released from their obligation to pay. Further claims due to delay in delivery or failure of delivery are excluded.
Data protection
Our data protection declaration, which forms an integral part of these terms and conditions, applies to the processing of personal data by the seller. Applicable Law and Jurisdiction.
